TERMS AND CONDITIONS


  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over.
  3. Employees of the following (and their immediate family) are not eligible to enter this promotion: the Promoter, the Westfield Group, any of the tenants or retailers in the participating Westfield Centre and the agencies associated with this promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Promotion commences 9am AEDST on Tuesday 1 March 2011 and closes 5pm AEDST on Sunday 20 March 2011 ("Promotional Period").
  5. To enter, eligible entrants must, during the Promotional Period, visit www.westfield.com.au, follow the prompts to the competition entry page, fill in the requested details including their full name, address, age, email and contact telephone numbers, answer all of the questions provided including describing why they should win in 25 words or less and electing the participating Westfield Centre they are able to attend should they win and submit the fully completed entry form. Entrants must upload with their entry a recent, clear, colour photograph of themselves.
  6. As a condition of submitting an entry, entrants agree that they will be signed up to the email newsletter of the participating Westfield Centre they nominate in their entry (if they are not already signed up).
  7. Only entries received via www.westfield.com.au will be accepted and only one (1) entry per person is permitted. Incomplete or incomprehensible entries will not be included in the judging.
  8. The Promoter reserves the right, at any time, to verify the validity of entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant that submits an entry that is not in accordance with these Terms and Conditions or tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  9. All entries (which shall include the photographs submitted) become the property of the Promoter. As a condition of entering into this promotion, each entrant agrees to, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display the entry for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants further acknowledge and agree that elements of their entry may be displayed on the Promoter's website during the Promotional Period and for a period of up to six (6) months afterwards. Entrants agree not to assert any moral rights in relation to such use by the Promoter. Entrants warrant that they have the full authority to grant these rights.
  10. Each entrant warrants to the Promoter that (a) each photograph submitted is an original work which does not infringe the rights of any third party; (b) any information submitted as part of their entry is true; and (c) the photograph and entry submitted is of the entrant. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranties set out in this condition. The Promoter is entitled to use any of the entrants' entries for any purposes at its discretion, including using the photographs for future promotional, marketing and publicity purposes, without further remuneration.
  11. Entries will be divided into the following ten (10) groups based on the participating Westfield Centre nominated at the time of entry: Parramatta (NSW); Miranda (NSW); Kotara (NSW); Hornsby (NSW); Belconnen (ACT); Marion (SA); Chermside (QLD); Carindale (QLD); Southland (VIC); and Fountain Gate (VIC).
  12. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on creative merit and originality, as well as the compulsory photograph submitted. The judging will take place at 100 William Street, Sydney NSW 2011 from Wednesday 23 March 2011.
  13. The best valid entry in each of the ten (10) groups will each win a makeover and prize pack valued at up to $2,000, consisting of the following:
    • 1 x two (2) hour personal styling session with a Westfield stylist at the winner's nominated Westfield Centre;
    • 1 x $1,000 Westfield Gift Card; and
    • 1 x on-stage makeover with Gok at the winner's nominated Westfield Centre.
  14. There will be a total of ten (10) prizes awarded in this promotion. The judges reserve the right to select additional reserve entries which they determine to be potential runner up winners, and record them in order of merit for use in case of an invalid entry or ineligible entrant. The Promoter's decision is final and no correspondence will be entered into.
  15. Winning entrants ("Winners") will be notified by telephone and email on Wednesday 23 March 2011 or Thursday 24 March 2011.
  16. Winners will be notified of the day of their makeover event, which they must attend to participate in their on-stage makeover, as well as receive all other elements of the prize pack. Winners must be available to attend the event on the date specified which will be a date in late March/April 2011 to be determined by the Promoter in its absolute discretion and subject to Gok's availability. If a Winner is not available to attend on the date specified they will be deemed invalid and a new Winner will be selected from the reserve entries.
  17. Winners (and any companions) are responsible for all costs associated with attending their makeover event, including but not limited to travel to and from the participating Westfield Centre nominated in their entry form.
  18. Any ancillary costs associated with redeeming the Westfield Gift Card are not included. Any unused balance of the Westfield Gift Card will not be awarded as cash. Westfield Gift Card terms and conditions apply and only redeemable at participating stores. Westfield Gift Cards are issued by Westfield Gift Card Pty Ltd ACN 113 171 663.   19. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  22. By accepting a prize, each Winner acknowledges and agrees that:
    • they must not act in an illegal or inappropriate manner during the course of the on-stage makeover event;
    • they may be contacted by the Promoter via telephone and/or email during or after the promotion;
    • during the course of the on-stage makeover event they: (i) will follow all reasonable directions of the Promoter; (ii) will not be involved in any illegal or scandalous behaviour which could bring the Promoter or its products into disrepute; and (iii) understand that they may be interviewed, photographed, filmed and recorded during the entire duration of the on-stage makeover event.
    • that the Promoter may use the content recorded during the on-stage makeover event ("Materials") for any purpose, including for the Promoter's future promotional and marketing purposes without further reference or compensation to them, including but not limited to, displaying the Materials in any form of media including on digital advertising, WAP sites, outdoor advertising, using it in PR, radio, TV, on Facebook, My Space, and YouTube;
    • the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
    • where they have any intellectual property rights in the Materials, they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
    • they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
    • they waive all Moral Rights in the Materials that arise outside Australia;
    • they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials; and
    • they agree to participate in any further publicity activities for the purposes of promoting this promotion (including any outcome) as determined by the Promoter in its absolute discretion, including, but not limited to, appearing as talent in a "Style TV" episode to be displayed on westfield.com.au and other digital media as determined by the Promoter.
  23. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  24. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Trade Practices Act, ASIC Act, or the Competition and Consumer Act including the guarantees under the Australian Consumer Law or similar laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Westfield Group of companies (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion
  25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Westfield Group of companies (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or Winner; (f) if the appearance of Gok is cancelled for any reason beyond the reasonable control of the Promoter; or (g) use of, or participating in, a prize.
  26. As a condition of accepting a prize, Winners must sign any legal documentation as and in the form required by the Promoter in its absolute discretion including but not limited to a legal release and indemnity form.
  27. In order to conduct this promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Westfield database. The Promoter and the Westfield Group may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Westfield Privacy Policy. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Promoter and/or Westfield. Upon the entrant's request, all information provided will be removed from our active database.
